Article 2 - Subject Matter
This Agreement determines the rights and obligations of the parties regarding reservation services requested by the Service Recipient through www.voyagoo.com.tr, in accordance with Turkish Consumer Protection Law No. 6502, the Distance Contracts Regulation, and the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce. Voyago acts as an intermediary between the Supplier and the Service Recipient.
Article 3 - Service Information
Order No/Date: Auto-filled. Service/Product Type: Accommodation / Tour / Car Rental / Transfer / Other. Supplier: Supplier name. Service Date/Duration: Start - End date. Total Amount (VAT included): Amount in local currency. Payment Method: Credit Card / Debit Card / Bank Transfer / Digital Wallet. Delivery: Electronic reservation confirmation and/or relevant voucher delivery.
Article 4 - Contract Formation
The Service Recipient's identity/contact information and order details are automatically populated by the system from the data entered during the booking/payment process. The Service Recipient is deemed to have accepted this Agreement by checking 'I have read and accept the Distance Sales Agreement' on the payment screen. A copy of the confirmed Agreement is stored in the Service Recipient's Platform account and/or the email address provided.
Article 5 - General Provisions
The Service Recipient is responsible for providing accurate and complete booking information. Checking reservation details before payment is the recipient's responsibility. Services should only be used for legitimate purposes. The Supplier is responsible for the provision of the service. In cases of force majeure (natural disasters, epidemics, war, government decisions, Supplier bankruptcy), the parties agree to apply the solutions provided for by regulations.
Article 6 - Right of Withdrawal
The Service Recipient has the right to withdraw from the contract within 14 (fourteen) days from the date of contract formation without any reason and without any penalty, provided that the service has not yet begun. To exercise this right, written notification to [email protected] within this period is sufficient. In case of withdrawal, the paid amount is refunded within 14 days via the original payment method. Exceptions in Article 7 apply.
Article 7 - Exceptions to Withdrawal Right
Under Article 15 of the Distance Contracts Regulation, the Service Recipient cannot exercise the withdrawal right in the following cases: (a) Accommodation, car rental, and leisure contracts to be performed on a specific date or period (e.g., hotel reservations, tour packages, car rentals); (b) Contracts related to services whose prices fluctuate based on financial market conditions; (c) Services that have begun execution with the Service Recipient's approval before the withdrawal period expires. For services under these exceptions, cancellation/refund terms per Voyago's Cancellation & Refund Policy and the relevant Supplier's conditions apply.
Article 8 - Default & Legal Consequences
If the Service Recipient uses a credit card as the payment method and subsequently defaults, they agree to pay interest and be liable to the issuing bank under the credit card agreement. In such cases, the relevant bank may pursue legal action. If the Service Provider fails to perform its obligations, the Service Recipient may exercise their rights under applicable law and regulations.
Article 9 - Jurisdiction & Article 10 - Entry into Force
Article 9: Consumer Arbitration Committees and Courts at the Service Recipient's place of transaction or residence have jurisdiction over disputes, in accordance with Consumer Protection Law No. 6502. Consumer Arbitration Committees and Courts in Bursa also have jurisdiction. Article 10: By confirming the order on the Platform, the Service Recipient declares that they have read, understood, and accepted this Agreement. This Agreement enters into force on the date the order is confirmed electronically.
